The president of Banco Opportunity, Dório Ferman, an ally of businessman Daniel Dantas, filed this Friday (/) with a new request for the removal of judge Fausto De Sanctis, from the th Criminal Court of the Federal Court of São Paulo, from the case of Operation Satiagraha, of the Federal Police. Ferman and Dantas are investigated for financial crimes by Operation Satiagraha. The information is from Folha Online .
Ferman's lawyer, Antônio Sérgio Pitombo, stated that De Sanctis can no longer judge the case because he filed a lawsuit against Veja magazine last month. "Unfortunately, it is not possible for the judge to have a Canada Mobile Number List question of private interest in a case he judges. It is nothing personal, it is a procedural question", said the lawyer. According to the Federal Court's office, the judge will not comment on the request.
The request was delivered to the judge himself. If he denies the removal, the request goes to the Federal Regional Court of the rd Region, in São Paulo. This is not the first attempt by Opportunity's lawyers to remove De Sanctis from the case. On March , the Superior Court of Justice maintained, by votes to , the judge at the head of the process.
According to Dantas' defense, De Sanctis was being biased in the case. In December last year, Minister Arnaldo Esteves Lima, from the STJ, ordered the interruption of criminal actions in which Dantas appeared as an accused and had the judge's role. The defense also requested the recognition of De Sanctis' suspicion and the redistribution of the criminal action against Dantas to the federal court of the nd Federal Criminal Court of São Paulo, in addition to the recognition of the nullity of all jurisdictional acts already carried out by the judge.
